Agreement for Construction Services

These Terms of Service ("Terms") govern your use of the REISS BUILDS website (www.reissbuilds.com) and our construction, remodeling, and renovation services. By accessing our website or engaging our services, you agree to be bound by these Terms.

REISS BUILDS is a Florida licensed general contractor (CBC1268455) providing residential and commercial construction services throughout South Florida.

1. Acceptance of Terms

By accessing and using this website or engaging our services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Construction Services

2.1 Scope of Work

Specific construction services will be detailed in a separate written contract for each project. These Terms supplement but do not replace individual project contracts.

2.2 Estimates and Quotes

  • All estimates are valid for 30 days unless otherwise specified
  • Estimates are based on current material and labor costs
  • Final pricing may vary based on actual site conditions
  • Written change orders required for scope modifications

2.3 Licensing and Permits

REISS BUILDS will obtain necessary permits for covered work. Property owner is responsible for HOA approvals unless otherwise agreed in writing.

3. Payment Terms

3.1 Payment Schedule

Unless otherwise specified in the project contract:

  • Initial deposit required to secure scheduling (typically 10-30%)
  • Progress payments tied to completion milestones
  • Final payment due upon substantial completion
  • Retention amount per Florida construction law

3.2 Late Payments

Late payments may be subject to interest charges at the maximum rate allowed by Florida law. Work may be suspended for accounts more than 15 days past due.

3.3 Additional Costs

Client is responsible for any additional costs arising from hidden conditions, code requirements discovered during work, or client-requested changes.

4. Website Use

4.1 Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of REISS BUILDS and protected by copyright laws.

4.2 Prohibited Uses

You may not:

  • Use the website for any unlawful purpose
  • Attempt to gain unauthorized access to any portion of the website
  • Use any robot, spider, or other automatic device to monitor or copy our website
  • Reproduce, duplicate, copy, sell, or resell any portion of the website

4.3 User Content

By submitting content to our website (reviews, photos, etc.), you grant REISS BUILDS a non-exclusive, royalty-free, perpetual right to use, reproduce, and distribute such content.

5. Warranties and Guarantees

5.1 Workmanship Warranty

REISS BUILDS provides a one-year warranty on workmanship from the date of completion, unless otherwise specified in the project contract.

5.2 Material Warranties

Manufacturer warranties on materials and equipment pass through to the client. REISS BUILDS makes no additional warranties on materials beyond manufacturer specifications.

5.3 Warranty Limitations

Warranty does not cover:

  • Normal wear and tear
  • Damage from misuse or neglect
  • Acts of God, including hurricanes and flooding
  • Work performed by others
  • Pre-existing conditions

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REISS BUILDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount paid by you for the specific service giving rise to the claim.

7. Indemnification

You agree to defend, indemnify, and hold harmless REISS BUILDS and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your breach of these Terms or your use of our services.

8. Force Majeure

REISS BUILDS shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, hurricanes, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

9. Insurance

9.1 Our Insurance

REISS BUILDS maintains general liability insurance and workers' compensation coverage as required by Florida law.

9.2 Client Responsibilities

Client must maintain adequate property insurance during construction. Client should verify coverage for construction projects with their insurance carrier.

10. Dispute Resolution

10.1 Negotiation

Parties agree to first attempt to resolve disputes through good faith negotiation.

10.2 Mediation

If negotiation fails, disputes shall be submitted to mediation before a mutually agreed mediator in Palm Beach County, Florida.

10.3 Legal Action

If mediation fails, disputes may be resolved through legal action in Palm Beach County, Florida courts. The prevailing party shall be entitled to reasonable attorney's fees.

11. Termination

11.1 Termination by Client

Client may terminate services upon written notice. Client remains responsible for work completed and materials ordered.

11.2 Termination by REISS BUILDS

We may terminate services for non-payment, unsafe conditions, or material breach of contract terms.

12. Miscellaneous

12.1 Entire Agreement

These Terms, together with individual project contracts, constitute the entire agreement between parties.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

12.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

12.4 Assignment

You may not assign or transfer these Terms without our prior written consent.

13. Florida Construction Law

13.1 Notice of Defects

Per Florida Statute Chapter 558, written notice of construction defects must be provided at least 60 days before filing legal action.

13.2 Right to Repair

REISS BUILDS shall have the opportunity to inspect and offer to repair alleged defects before legal action.

13.3 Lien Rights

REISS BUILDS reserves all lien rights under Florida construction lien law. Notice to Owner may be served as required by law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action must be brought in Palm Beach County, Florida.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website or our services constitutes acceptance of modified Terms.
